Terms and Conditions and Cancellations:
Online booking of a stay in seasonal rental accommodation
Conditions applicable to all bookings
1 – The parties to the contract:
“You” or “the Customer” or “the Buyer” means any user of this site who reserves, orders and/or
purchases all Products and Services offered You may only use this Site if You are of legal age and authorized to
sign contracts that engage your responsibility. You will be financially responsible for all of your
uses of the Site.
The services sold on this site are reserved for individuals. Groups and professionals
must contact the Seller directly.
“We” or “the Seller” designates the legally authorized reservation center offering for sale the
rentals, stays and tourist packages on behalf of its principals and committing to respect the rules
following professionals: article 68 of the decree of 1972 modified for rentals of gîtes outside the package, articles
R211-3 to R211-11 of the Tourism Code for travel and tourist packages.
Charges for monthly rentals: water, electricity, insurance, common electricity, internet and TV, air conditioning, housing tax… Flat rate of €150 tourist tax in addition, current rate from the town hall
2 – Object of the contract:
The purpose of this contract is to ensure remote electronic booking
of a stay in accommodation.
3 – Online option taking:
This site allows you to put an option on the reservation of a stay in
accommodation whose validity period is mentioned on the contract proposal issued by the
Seller. By placing an option, You block the reservation of the stay for a period of 7 days. You will recieve
then a reservation contract by post or electronic mail or SMS. Please note: the Seller must have received,
before the date appearing on the contract, your signed contract as well as your payment so that your
reservation becomes final. Otherwise, your booking option will be considered unconfirmed and
the Vendor will put the holiday in question back on sale and the deposit lost.
4 – Online booking:
After making your selection.
An email or SMS then summarizes all the specific elements appearing in the contract.
By calling to CONFIRM, the customer validates and confirms his order, declares to have taken
knowledge and accepted these booking conditions, and is irrevocably bound. Its acceptance
may subsequently be called into question except in application of the article relating to the right of withdrawal.
The recording systems set up by the Seller are considered as proof
the conclusion of the reservation contract.
The Customer will receive a confirmation of the order by e-mail or sms. This confirmation will trace the
essential characteristics of the reservation, its price and its terms of payment. The content of these
booking confirmations is archived by the Seller. They are considered as proof of
customer’s consent to the reservation contract and its date.
5 – The means of payment of the price of the service:
Online payment by credit card allows You to
book your stay online and immediately in a firm way. If the delay between the reservation date and the
start date of the stay is less than 7 days, only payment by credit card is offered to You.
For options, the payment of the deposit can be made by check, money order, transfer, and CCP; besides
these means of payment, payment of the balance can also be made by bank card.
6 – Non-transferability of the contract:
Except application of article 32 of these conditions of sale, this contract
is concluded intuitu personae and cannot be transferred.
7 – Accommodation capacity:
The contract is established for a specific capacity of people. If the number of
holidaymakers exceeds the accommodation capacity, the service provider may refuse additional Clients. In this case,
any modification or termination of the contract will be considered at the initiative of the Customer.
8 – Your pets:
Pets are prohibited at the La Ciotat duplex. In the event of non-compliance with this clause by the Customer, the service provider may refuse the stay. In this case,
no refund will be made.
9 – Cancellation by the customer:
Any cancellation must be notified by registered letter to the service of
reservation.
You do not benefit from personal cancellation insurance: for any cancellation caused by the Customer, the
reimbursement will be made by the reservations department (with the exception of administration fees if these have been
paid when booking €35) under the following conditions:
